This Web Site Contains A Binding Arbitration Provision Which May Be Enforced By The Parties

Dispute Resolution – Any dispute, controversy or claim ari sing out of or relating to this Terms of Use Agreement or its performance, including the validity of this Terms of Use Agreement or use of this Web Site, shall, if possible, be decided amicably by the parties. In the event that the parties are unable to reach an amicable settlement within 30 days of one party giving notice to the other of a dispute, controversies or claim, the matter shall be settled by arbitration by a three (3) member arbitration board which shall hold its sessions in Singapore in the English language in accordance with the rules of the Singapore International Arbitration Centre as currently in force.. The arbitral award made and granted by the arbitrators shall be final and binding an incontestable and may be used as a basis for judgment in Indonesia or elsewhere. The arbitration board shall render its decision in English and must state reasons for their decision in writing and shall be bound by strict riles of law in making their decision and shall not be entitled to render a recision ex aequo et bono. The arbitration board shall in its decision make a determination as to the payment of costs and expenses of the arbitrators, the administrative costs of the arbitration, the legal fees incurred by the parties and all other costs necess ari ly incurred by the parties. The parties expressly agree to waive any Indonesian laws and regulations which would give the right to appeal the decision of the board of arbitration, so that the decision of the board of arbitration will not be subject to appeal to any court or any other authority of the Republic of Indonesia or panel. Each of the parties also hereby irrevocably waive the applicability of any applicable laws so that the mandate of the board of arbitration duly constituted in accordance with the terms of this Term of Use shall remain in effect until a final arbitration award has been issued by the board of arbitration.

Language; Governing Law; Jurisdiction; Severability of Provisions – The Terms of Use have been prepared in English and Bahasa Indonesia. In the event of any inconsistency between the English version and the Bahasa Indonesia version, the English version shall prevail unless Indonesian law provides otherwise. The Terms of Use are governed by the laws of the Republic of Indonesia. If any provision is deemed unlawful or unenforceable, it will not affect the validity and enforceability of the remaining provisions. The section headings are for convenience only and do not have any force or effect.

Password Accounts, Passwords, and Security.
